SMS & RCS Messaging Terms

These SMS & RCS Messaging Terms ("Terms") govern your participation in the 8Motiv LLC SMS and RCS Messaging Program. By providing your mobile phone number and expressly opting in to receive text messages from 8Motiv LLC ("8Motiv," "we," "our," or "us"), you agree to these Terms.

PROGRAM DESCRIPTION

By enrolling in our SMS and RCS Messaging Program, you consent to receive recurring automated and non-automated SMS (Short Message Service) and RCS (Rich Communication Services) messages from 8Motiv regarding your purchases, account activity, customer support, promotions, product recommendations, exclusive offers, and other information related to our products and services.

Message frequency varies based on your interactions with us, your purchases, your communication preferences, and ongoing promotional campaigns. Consent to receive SMS or RCS messages is not a condition of purchasing any goods or services.

HOW TO OPT IN

You may opt in to receive SMS and RCS communications by providing your express consent through one or more of the following methods:

  • Checking the SMS consent box during checkout.
  • Subscribing through a website form, pop-up, or landing page.
  • Creating or updating your customer account and choosing to receive text messages.

MESSAGE FREQUENCY

COSTS

Message and data rates may apply according to your wireless carrier's messaging plan. You are responsible for any charges imposed by your mobile carrier.

OPTING OUT

You may opt out of receiving marketing text messages at any time by replying STOP to any SMS or RCS message.

Depending on your wireless carrier, equivalent commands such as STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT may also be recognized.

After opting out, you will receive one final confirmation message confirming that your request has been processed.

Opting out of marketing messages does not prevent us from sending transactional or service-related communications that are necessary to complete your purchases, fulfill your orders, respond to your requests, protect your account, or comply with applicable legal obligations.

RCS AVAILABILITY

RCS messaging is available only on compatible devices and supported wireless carriers. If RCS is unavailable, your message may be delivered as a standard SMS message where applicable.

CARRIER DISCLAIMER

Wireless carriers are not liable for delayed, undelivered, or misdirected messages.

PRIVACY

Your mobile phone number and your SMS/RCS consent information will be processed in accordance with our Privacy Policy.

Mobile opt-in data, consent records, and related personal information will never be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

We may share your information only with trusted service providers that assist us in delivering our messaging services, processing customer communications, or complying with legal obligations, and only to the extent necessary to provide those services.

ELIGIBILITY

By opting into our messaging program, you represent and warrant that:

COMPLIANCE

8Motiv LLC complies with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act where applicable, the CTIA Messaging Principles and Best Practices, and all other applicable federal and state laws governing SMS and RCS communications.

CHANGES TO THESE TERMS

We reserve the right to modify, update, suspend, or terminate our SMS and RCS Messaging Program or these Terms at any time.

Any changes will become effective immediately upon posting the updated Terms on our website. Your continued participation in the messaging program after such changes constitutes your acceptance of the revised Terms.
